MLMIC Insurance Company is proud to present the latest episode of Talk Studio, a video series on important and trending issues in professional liability, healthcare law and risk management.

Here, Nancy May-Skinner, Esq., and Brian Felton, Esq., discuss whether a practice can start limiting new patients to those vaccinated against COVID-19.

Prompted by a recent policyholder inquiry, Felton explores whether a practice can accept only new patients who have received COVID-19 vaccines. He shares his insights on key considerations that should be explored before implementing any such policy, such as potential violation of the Americans with Disabilities Act (ADA). May-Skinner and Felton also discuss how professional codes of conduct and professional ethics have to be considered as well when thinking about limiting new patients to those vaccinated against COVID-19.

“I can see a scenario where it could potentially be a violation of the ADA, and specifically a scenario where you have a patient that has a disability that prevents that patient from receiving the COVID-19 vaccine,” said Felton.
